Apex Sim Racing Shipping Insurance Policy

Introduction:
This Shipping Insurance Policy outlines the terms and conditions under which Apex Sim Racing LLC ("we", "us", "our") offers shipping insurance to our customers ("you", "your") for products purchased through apexsimracing.com. By opting for shipping insurance, you agree to the terms set forth in this policy.
Eligibility:
All customers who purchase products from Apexsimracing.com and select shipping insurance at checkout are eligible for coverage under this policy.
Coverage Details:
Our shipping insurance covers loss, damage, or theft of your product(s) during transit. Coverage is limited to:
- Loss or Theft of the product in transit.
- Physical damage to the product during shipping.
Coverage does not include:
- Damage due to improper use or handling after delivery.
- Loss or damage reported after 10 Days of confirmed delivery.
Cost:
The cost of shipping insurance is a percentage of the total order value. This fee is non-refundable and is in addition to standard shipping charges.
Claim Process:
In the event of loss, theft, or damage, you must file a claim by contacting our customer service team within 10 days of the scheduled delivery date. The claim must include:
- Order number.
- Detailed description of the issue.
- Photographic evidence (for damages).
For Loss or Theft, a package search claim must be completed by the shipping carrier. Once completed with an outcome, the claim will be processed within 15 days, and you will be notified of the outcome.
Additional Requirements for Claims Involving Delivered Yet Not Received Packages:
Filing a Police Report: If your package is marked as delivered but you have not received it, you are required to file a police report. In your report, please include a statement that explains the package, insured by Apex Sim Racing's Shipping Protection policy, has been stolen. This is a necessary step to process your order issue with us.
Submission of Police Report: After filing the report, please send a PDF copy of the police report to Apex Sim Racing.
Additional Documentation: Apex Sim Racing may request further documentation (such as proof of identity or address) to support your claim.
Note: Filing a false police report is a serious offense and may be charged as a misdemeanor or a felony, depending on the jurisdiction.
Time Frame for Filing Claims: Order issues for packages marked "delivered" yet not received must be reported within 7 days after the “delivery date”, and no later than 30 days from the same.
Refunds and Compensation:
Upon a successful claim, we will provide compensation in the form of a replacement product. The maximum liability for any claim shall not exceed the purchase value of the product(s).
Limits of Liability:
The maximum liability for any one package or shipment under this shipping insurance policy is $2,500.
Liabilities and Limitations:
Apex Sim Racing is not liable for any loss or damage arising from:
- Incorrect delivery details provided by the customer.
- Delays due to unforeseen circumstances or force majeure.
- Any indirect or consequential loss.
Dispute Resolution:
Any disputes related to this shipping insurance policy will be resolved in accordance with the governing law of New Jersey.
Amendments:
Apex Sim Racing reserves the right to modify or amend this policy at any time. Any changes will be effective immediately upon posting to our website.
